Walter AG prioritises the protection of your data

Because the protection of your personal data is of vital importance to Walter AG and its subsidiaries all around the world (hereinafter separately and jointly referred to as "Walter"), we welcome the additional transparency and security that the General Data Protection Regulation (GDPR) prescribes with regard to your personal data.

Controller

The company within the Walter Group which originally collected your data and specified the purposes and means of processing is considered to be the controller for your data. A list of all the companies within the Walter Group and their contact details can be found here. This list includes links to the relevant e-mail addresses for data protection enquiries.

It is important to us that you feel confident in instances where we process your personal data ‒ whether as a customer, supplier/service provider, commercial or administrative intermediary, digitally registered person, physically registered person or visitor.

We have therefore compiled a list below which shows the categories of personal data we collect, what purposes they are processed for and what happens to them under our responsibility. We also explain what rights you have under the GDPR and specify the controllers whom you can contact with enquiries or requests concerning your data.

Definitions

The terms in the table below are defined as follows:

  • Customer: You or your employer has purchased products or services from us.
  • Supplier/service provider: You work for one of the many subcontractors from whom we source goods and services.
  • Commercial or administrative intermediary: You work for one of our many distributors or other intermediaries, such as dealers, commercial agents or customs agents.
  • Digitally registered person: You use our website, for example to 1) obtain information about our products and services, 2) sign up for newsletters or events supported by Walter, 3) register for a Walter subscription or forum or 4) respond to surveys or other marketing communications.
  • Physically registered person: You register with us in person at an event.
  • Visitor: You visit one of our locations, representatives or events.
Depending on the relationship you have with Walter and the activities you carry out, you may belong to multiple categories. If, for example, you have purchased one of our products, completed one of our online forms and visited one of our branches at some point, we consider you a customer, digitally registered person and offline visitor.

What personal data do we collect and what purposes is it processed for?

Service and warranty data (e.g. repair and maintenance history as well as earlier warranty claims). Performance of our contractual warranty obligations, improving product development and fulfilling our/your maintenance obligations.
Travel data (e.g. information about visas and passports, travel costs and routes). Organising journeys to Walter locations and events, including provision of visas.

Videos, photos, time and place of capture, registration numbers of vehicles. Limited video surveillance. Cameras are installed for the following purposes at some unstaffed gates to industrial sites:
  • Opening and closing gates safely, in order to prevent injury and damage to vehicles;
  • Checking that no unauthorised individuals gain access to the industrial site when the gates are opened;
  • Monitoring areas where unauthorised individuals could gain access to the industrial site without being seen;
  • Preventing or detecting material damage and associated offences;
  • Investigating accidents and other incidents.

If you have given your consent for us to process your personal data, the legal basis for this processing is Art. 6(1a) GDPR. You have the right to withdraw consent previously given, with effect for the future, at any time. We rely on your consent mainly in case of marketing of our own products when our contractual relation is over, as well as in case of marketing of third parties. In addition, we may ask for Your consent in case of your use of some Internet tools.

If the processing is necessary for the performance of a contract to which you are party, or for the performance of measures prior to the conclusion of a contract which take place following a corresponding enquiry, the legal basis is Art. 6(1b). This legal basis applies mainly with relation to order management and deliveries and warranty processing.

If the processing is necessary for fulfilling a legal obligation to which Walter is subject, the processing is based on Art. 6(1c). This concerns compliance with tax regulations, accountancy as well as financial control obligations.

Art. 6(1d) provides the legal basis in the event that the processing is necessary to protect your vital interests or those of another natural person. This legal basis can be used only in exceptional circumstances, for instance if person lost its conscious while visiting our company.

If the processing is necessary to protect the legitimate interests of Walter or a third party, the legal basis is provided by Art. 6(1f), unless these legitimate interests are outweighed by your interests or fundamental rights or freedoms that demand the protection of personal data. This provision would apply in case of our communication with you, when we process your data for the purpose of marketing of our own goods and services. In addition, we rely on our legitimate interests in case of limited video-surveillance, for the purpose of ensuring security at the company premises. We can also use profiling in order to tailor our communication to your expectations, although we do not take decisions based solely on the automated processing.

We only store personal data for as long as is necessary for the pursuance of the purposes of processing set out in this Privacy Notice, unless a longer storage period is prescribed by law or required for legitimate reasons or the justification or defence of legal claims.

Categories of recipients outside of Walter

Walter does not disclose your personal data to third parties unless this is justified by Walter's legitimate interests as set out below, in order to offer you Walter products and services at their usual high quality or in the case of a service provider that performs commissioned data processing on behalf of Walter on a contractual basis. The disclosure of your data to entities outside of the EU and EEA is solely permitted if an appropriate level of data protection is guaranteed in the recipient country, for example by an adequacy decision by the European Commission or by the European Commission's standard contractual clauses, or otherwise guaranteed by the data protection law that applies in the country in question. Walter transfer personal data outside the EEA e.g. in cases when it organises visits in such a country. If you are to take part in such a visit however, additional information will be provided to you. Below is the list of categories of data recipients.

  • Walter is entitled to disclose data concerning visitors, customers, registered individuals or suppliers to other Walter companies, provided that this is necessary in order to respond to an enquiry that you have submitted.
  • We are entitled to share data concerning visitors, customers and digitally or physically registered individuals within the Walter Group and to disclose this data to Walter business partners (such as authorised dealers) in order for these entities to offer you relevant Walter products and services, and so that we are able to jointly organise product demonstrations and other events.
  • We may have to pass data concerning visitors, customers and digitally or physically registered individuals to the competent authorities or other third parties in order to implement our data protection provisions or represent Walter's concerns pertaining to rights, property or security. We may also be obliged to disclose your data to government bodies due to legal obligations.

Your rights as a data subject

As a data subject, you have the right to obtain information on whether personal data that relates to you is stored by Walter, and if so what data. You have the right to have incorrect personal data rectified and under certain circumstances erased. Under certain circumstances, you may request the restriction of processing (blocking) of data, object to processing or have your data transferred to third parties.

You are entitled to lodge a complaint with the data protection authority under whose jurisdiction you fall. For example, this could be: 1) The Baden-Württemberg State Commissioner for Data Protection responsible for Walter AG as the parent company of the Walter Group, 2) the data protection authority in the country where the Walter company that collected your data is based or 3) the data protection authority in the country in which, in your opinion, your right to the protection of your personal data has been violated.

Data collected from other sources

Walter may occasionally collect data from other sources instead of from you directly. For example, this can occur if we receive information that concerns you from our business partners or suppliers. We also collect personal data from public sources, such as social networks. You will be informed about such external sources on a case-by-case basis if this applies.
